Poland will appeal to the European Court of Justice as it fights to overturn a European Union decision to grant industry players free CO2 emissions permits.
The Polish application is expected to be filed within a few weeks, Rzeczpospolita reports Deputy Minister of Economy, Marcin Korolec, as saying.
On Wednesday, the European Commission adopted rules for calculating the number of free permits which industry players could receive.
Poland says emissions levels (which are taken into account as part of the calculation process) are determined using modern technology available throughout the EU, but not necessarily in Poland.
Mr Korolec also argues Poland will have a tough time scoring points, as much of the calculations are based on gas fuel consumption, while Poland still burns a lot of coal for fuel.
