4Link charged with breaking the data protection law
On April 20 the Voivodship Administrative Court in Warsaw will decide whether Link4, an insurance company, broke the law by demanding too much data from its clients.
Link4 sells mainly car insurance policies by telephone. The potential client first needs to call and give his personal data, the Link4 employee calculates the individual premium, then the customer receives the documents by post, signs them and after sending the documents back and paying the premium he gets his insurance documents. The Chief Inspector for Personal Data Protection (GIODO) questioned the way in which the data is collected. Moreover, he demanded that Link4 remove from its inventory the data of persons which did not conclude contracts and introduce ID tags on those who have access to the company's data systems. "I do not understand the need to give one's name and family name at the initial stage. Age, voivodship and one's insurance history should be enough for the company to calculate the premium," said Piotr Wojcik, the lawyer of GIODO. Link4 explained that the client agrees to give all the data. However, even if the client does not decide to sign an agreement, his data is nevertheless processed by the company, which according to GIODO is against the law. (Puls Biznesu, p. 14) E.B.
